Update 06/27/2025: The Supreme Court ruled to limit federal judges’ ability to issue nationwide injunctions, a major blow to efforts that block unconstitutional policies like Trump’s attack on birthright citizenship. For now, the injunction remains in place for 30 days to allow lower courts to address the constitutionality of Trump’s executive order.
The New Americans Campaign has created a Community Explainer regarding the recent executive order, “Protecting the Meaning and Value of American Citizenship,” signed by President Trump on January 20, 2025. This order aims to deny federal documents recognizing U.S. citizenship (such as social security cards and U.S. passports) to children born in the United States to certain noncitizen parents. The order is set to take effect on February 18, 2025, and is not retroactive.
While this attempt to end birthright citizenship is widely viewed as unconstitutional and likely to fail, it has already created significant fear and confusion within immigrant communities.
